October 2023 DOL Update: PERM Applications and Prevailing Wage Determinations Processing Status

As of October 31, 2023, the Department of Labor (DOL) is in the process of conducting analyst reviews for PERM applications submitted in December 2022 or earlier. Additionally, the department is actively processing audited cases with priority dates of July 2022 or earlier. Standard reconsideration requests filed in January 2023 or earlier are also under review.

Regarding prevailing wage determinations (PWDs), as of October 31, 2023, DOL is issuing determinations for PERM prevailing wage requests filed in March 2023 (OES) and February 2023 (non-OES). For H-1B prevailing wage requests, the processing includes those filed in March 2023 (OES and non-OES). The agency is diligently handling PERM prevailing wage redeterminations requested in April 2023 and H-1B prevailing wage redeterminations requested in June 2023. Pending are the reviews for PERM and H-1B Center Director reviews requested in June 2023.
