USCIS is taking continuous measures to ensure that petitioners use the correct I-9 form to avoid penalties and comply with the laws. As part of this effort, USCIS has released the update on form I-9, stating that the prior version of form I-9, edition dated 10/21/19, will expire on October 30, 2023.
From November 1st, 2023 onwards, petitioners must exclusively use form I-9 for employee eligibility verification. If they fail to do so, they may be subject to all applicable penalties under section 274A of the INA, 8 U.S.C. 1324a, as enforced by U.S. Immigration and Customs Enforcement (ICE).
