Effective from February 27, 2024, Ukrainian citizens and their immediate family members, who were initially paroled into the United States on or after February 11, 2022, can now apply for re-parole. This process allows them to extend their temporary stay in the U.S. on a discretionary, case-by-case basis, considering urgent humanitarian reasons or significant public benefit. The re-parole application, accepted by USCIS under section 212(d)(5)(A) of the Immigration and Nationality Act, requires submission of Form I-131 along with supporting documentation. Eligible applicants must demonstrate continued urgent humanitarian reasons or significant public benefit, warrant a favorable exercise of discretion, and clear biographic and biometric background checks. The application can be filed online or on paper, with USCIS encouraging online filing for efficiency. If approved, applicants may then apply for employment authorization using Form I-765. Certain parolees, during the adjudication of their EAD applications, can use their new Form I-94 as evidence of identity and employment authorization for up to 90 days from their date of hire. This measure aims to support Ukrainians facing ongoing extraordinary circumstances due to Russia’s invasion of Ukraine in 2022.
