USCIS recently announced they would pick the additional H1B registrations to meet the FY 2024 H-1B numerical allocations. After conducting a random selection process from the remaining FY 2024 registrations submitted correctly, they have selected an adequate number of registrations to meet the H1B cap requirements.
USCIS has informed all potential petitioners whose registrations were selected in this second H1B lottery round that they are now eligible to file an H-1B cap-subject petition for the beneficiary listed in the selected registration.
To successfully submit an H-1B cap-subject petition, it is essential to file it correctly at the correct service center within the specified filing period mentioned in the registration selection notice. The filing period for the H-1B cap-subject petition will be at least 90 days.
Since online filing is not an option for H-1B petitions, petitioners must submit their petitions in paper format. Along with the H-1B cap-subject petition, petitioners must enclose a printed copy of the relevant registration selection notice for FY 2024.
The registration selection process solely determines eligibility for filing an H-1B cap-subject petition. However, it’s important to note that petitioners, whether they are eligible for the advanced degree exemption or not, must still demonstrate their eligibility for approval based on the existing statutory and regulatory requirements.
